Your advertising business with IOC® does not create a Listing agreement with IOC® unless there is a written contract with IOC® and you (advertiser)is not repsented by IOC® A MONTHLY USE then within days you will be given an <b>IOC® User Name and Password </b>for a One (1) "IOC® Cabinet PDIF" Data Form, hereinafter called "IOC® Cabinet PDIF", to build data and scenarios for months or longer then renewable every monthly or I'll canceled before renewal. IOC® Realty Specialist Inc., a Nebraska Corporation, hereinafter called "IOC®". IOC® trademarks, brands, and/or products are not sold; rather, copies of IOC® Trademarks, Designs, Brands, Products and Data Form Storage, are licensed all the way through the licensing distribution channel to the end user. UNLESS YOU HAVE ANOTHER AGREEMENT DIRECTLY WITH IOC® THAT CONTROLS AND ALTERS YOUR USE OR DISTRIBUTION OF THE IOC® Trademarks, Designs, Brands, Products and Data Form Storage, THE TERMS AND CONDITIONS OF THE APPLICABLE LICENSE AGREEMENTS APPLY TO YOU. Please read the agreements applicable for the trademarks and products you want to use. By completing this form and becoming an IOC® Licensed user, you hereby agree that all IOC® Trademarks, Designs, Brands, Products and Data Form Storage remain the property of IOC® and that I will complete all future IOC® Licensing Forms to keep my License agreement in full force. Trademark Licensing Agreement & Network Membership with the IOC® Network and its associated documentation's copyrighted and proprietary information protected by the laws of the United States Trademark Office. The Licensed Trademarks and Designs are the sole property of IOC®. IOC® grants, you, the Licensed Member a Licensee of a non-exclusive and nontransferable "IOC® PDIF" license, and the right to use the IOC® "PDIF". Your right to use this "IOC® Cabinet PDIF" upon the violation of any provision of this Licensing Agreement. If any provisions of this License Agreement is held to be unenforceable, such holding shall not affect the enforceability of any other provisions hereof. Licensed Trademarks, Designs and "IOC® Cabinet PDIF" are the sole property of IOC® associated licensing documentation. Single User: If you have not purchased a territory that is clearly designated as a territory, the IOC® Trademarks, Designs, Brands, Products and Data Form Storage can only be used by you, therefore, you can not shared the IOC® Trademarks, Designs, Brands, Products and Data Form Storage with any other person or entity, unless specially authorized in writing and notarized allowing you to do so. Your license grants you to use the IOC® Licensed "IOC® Cabinet PDIF" solely for improving your investment knowledge and marketing purposes of yourself to a Buyer or Seller and the general public. The IOC® Licensed Trademarks, Designs, Brands, Products and Data Form Storage are provided "as is" without warranties of any kind either expressed or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other that those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement. IOC® does not warrant that the, IOC® Trademarks, Designs, Brands, Products and Data Form Storage contained in the Licensed Trademarks and Designs will meet your requirements or that the operation of the Licensed IOC® Trademarks, Designs, Brands, Products and Data Form Storage will be error free. Should the Licensed IOC® Trademarks, Designs, Brands, Products and Data Form Storage prove to be unsuitable for your or your operation, you (and not IOC®) assume the cost of adjustments, repair, correction or discontinued use. No oral advice or written information given by IOC®, its employees, licensers or the like, shall create a warranty; nor shall you rely on any such information or advice. Upon request of IOC®, You agree to defend, indemnify and hold harmless IOC® its officers, directors, employees, agents and licensees, from any claims and expenses, including reasonable attorney's fees, in connection with your use of the IOC® Services, Designs and/or Products. This Agreement shall be governed by the laws of the State of Nebraska (excluding choice of law rules). This Agreement constitutes the entire agreement between you and IOC® with respect to your Association with IOC® its Service, Designs and Products. IOC®'s failure to enforce any provision hereof shall not be construed as a waiver of any provision or right. In the event that a portion of this Agreement is held unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of the provisions shall remain in full force and effect. Failure to have your IOC® Licensed Trademarks, Designs, Brands, Products and Data Form Storage Yearly Subscription License Fee paid is automatic termination of your licensing of the IOC® Trademarks, Designs, Brands, Products and Data Form Storage you will cease using the IOC® Licensed, Trademarks, Designs, Brands, Products and Data Form Storage and any associated documentation. I agree to the above and would like to be Licensed to use the IOC®, Trademarks, Designs, Brands, Products and Data Form Storage: "IOC® Cabinet PDIF". The IOC® "PDIF" Tool is an opportunity to help enhance your Investment. Now the IOC® "PDIF" selected by you will be paid in (U. S. CURRENCY) Dollars per month, renewed monthly by you, payable via Paypal. I am completing this form to use an ""IOC® Cabinet PDIF" Property Database Form" for a time period selected renewable ever month until I cancel and I agree and understand that the "IOC® Cabinet PDIF" is never one hundred per cent completed and is always changing and updating and that enhancements are not guaranteed and the "PDIF" is accepted "as is" for the amount stated within the subscription and can be canceled at any time without any refunds at any time. I have made a copy for my files submitting this form to IOC®. IOC® and its logos, and other IOC® logos and product and service names (collectively, the "Marks")are trade names, trademarks and/or intellectual property of IOC® and/or its subsidiaries. Without prior permission of the IOC®, you agree not to display or use in any manner, the Marks.
